amended to provide this number of stalls, which may not be utilized for <br />outdoor storage. <br />14. The property, including buildings and exterior site areas, shall comply <br />with all applicable fire codes. The fire chief should comment on <br />compliance with this regulation. <br />15. All lighting shall be hooded and so directed that the light source shall not <br />he visible from the public right -of -way or from neighboring residential <br />uses, and shall be in compliance with Section 903.020.1 of the Zoning <br />Ordinance. The site plan does not detail the layout of the site lighting — <br />this requirement shall be a condition of approval. <br />16. All other provisions and requirements as deemed necessary by the City <br />Council. <br />17. The applicant complies with the provisions of Section 921 of the Zoning <br />Ordinance. <br />Summary and Recommendation <br />The variance request is required to meet the traditional hardship test — that there is a <br />condition unique to this parcel that creates a hardship in putting the property to <br />reasonable use. As noted above, a finding could be made, based on the existence of <br />the Xcel easement, that this condition results in a building width that does not comprise <br />reasonable use. If that finding is made by the City, a variance may be approved. <br />The application for outdoor storage by CUP appears to meet most of the requirements <br />of the Zoning Ordinance, with the notation that a number of detailed requirements are <br />pending the identification of tenants and the arrangement of the storage area on the <br />site. The storage area itself is in compliance with the dimensional and other <br />requirements of the ordinance. As discussed above, the site needs to demonstrate <br />additional parking staff availability — at minimum a total of 20 parking stalls that would <br />be paved and not used for outdoor storage. <br />Staff recommends approval of the CUP for outdoor storage, with the following <br />conditions: <br />a. The applicant obtains the appropriate licensing. <br />b. Verification that all storage is utilized by tenants of the building on this property. <br />c. Details of storage components, height, and arrangement are verified, and <br />monitored to comply with the provisions of the ordinance. <br />d. Shipping containers are maintained in accordance with the provisions of the <br />ordinance. <br />e. The applicant identifies the location of waste - handling containers in the allowable <br />storage area, or other location that would meet the requirements of the <br />ordinance. <br />f. The City's fire inspectors approve the location and layout of the storage area. <br />g. The applicant provide a lighting plan that is consistent with the zoning ordinance <br />requirements. <br />
