AN ORDINANCE AMENDING CHAPTER 802 <br />OF THE LITTLE CANADA CITY CODE RELATING TO <br />TOBACCO PRODUCTS <br />THE CITY COUNCIL OF THE CITY OF LITTLE CANADA, MINNESOTA <br />ORDAINS: Chapter 802 of the Little Canada City Code is amended as follows: <br />Section I <br />Add the following definitions to the text of Section 802.010: <br />(d) "Tobacco Store" means a retail establishment with an entrance door <br />opening directly to the outside that derives more than 90 percent of its <br />gross revenue from the sale of cigars, cigarettes, loose tobacco, cigarette <br />or cigar lighters, and tobacco- related devices and in which the sale of <br />other products is merely incidental. This definition does not include a <br />tobacco department or section of any business establishment with any <br />other kind of liquor, food or restaurant license. <br />(e) <br />(f) <br />"Tobacco- related device" means any item designed or marketed as being <br />for the purpose of holding tobacco for burning and smoking tobacco or for <br />storage of tobacco. Rolling papers and similar products are "tobacco - <br />related devices" for purposes of this Ordinance. <br />"Sampling" means the lighting and burning of a small amount of tobacco <br />by an employee of a Tobacco Store for the sole purpose of allowing a <br />customer or customers to sample the tobacco prior to purchase. A <br />"sample" quantity is an amount of tobacco reasonably calculated to burn <br />for no more than two (2) minutes. For cigars, cigarettes, and similar <br />products, a sample quantity is '/ of one product (e.g. 'h cigarette, % cigar). <br />Section 2 <br />Change the text of Section 802.020 and 802.025 as shown: <br />802.020. LICENSE REQUIRED. No person shall, directly or indirectly, <br />keep for retail sale, sell at retail, or otherwise dispose of Tobacco Products unless <br />licensed by the City of Little Canada. A Tobacco Store license is available to a <br />premises meeting the definition of such a store; a general sales and display license <br />is available to all other premises seeking a tobacco license. License applications <br />shall be submitted to the City Administrator together with the applicable license <br />fee as determined from time to time by City Council resolution. A license shall <br />be issued for the specific premises identified in the application. <br />802.025. RESTRICTIONS ON NUMBER OF LICENSES. The total <br />number of tobacco licenses within the City shall not exceed twelve (12). <br />3 <br />
