Section 3 Change the text of Section 803.030 as shown: 802.030. APPLICATION. Any person desiring a license to engage in the business of dealing and /or selling Tobacco Products shall first make application therefor to the Council of the City by filing with the City Administrator for presentation to the Council an application in writing, which application shall set forth the name and place of residence of the applicant and the exact location of the place at which the applicant proposes to carry on said business. An application to renew a Tobacco Store license shall include sufficient financial information to show compliance with the requirement that 90% of gross revenue derived from the sale of approved products. Said application shall be signed by the applicant in person, and when received by the City Administrator shall be placed on file; provided, however, that no such application shall be received unless it is accompanied by the payment of a fee as provided for herein. Section 4 Change the text of Section 802.070 as shown: 802.070. LICENSE RESTRICTIONS. A license shall be issued subject to the following restrictions: (a) The following restrictions apply to premises licensed as a Tobacco Store: (1) Indoor sampling of tobacco permitted by the Minnesota Clean Indoor Air Act (Minn. Stat. 144.4167) must be limited to the sample quantity as defined in this Ordinance. The store must com.1 with the Clean Indoor Air Act in all other respects. (1 No person shall permit a minor to sample tobacco. Tobacco sans es must be lit b an em lo ee of the store who must remain with the customer while the sample is consumed. (4) The store's operating hours may start no earlier than 8:00 A.M. and must end prior to 10:00 P.M. If a land use permit or restrictive covenant also contains provisions relating to operating hours, the more restrictive regulation shall apply. 4
