would be their permanent replacement sites and that this would be their final claim. IBC <br />agreed that for the purposes of its relocation claim, it would consider the Burnsville and <br />New Hope sites as its permanent replacement sites and this would be its final claim. <br />NOW, THEREFORE, in consideration of the foregoing and other good and <br />valuable consideration, the receipt and sufficiency which are hereby acknowledged, IBC <br />and the City agree to the following: <br />1. 'I' he City has approved the payment of IBC's moving costs claim in the <br />amount of $12,910.48. This payment shall serve as full and final payment <br />of all eligible relocation moving costs IBC has incurred as a result of <br />being displaced by the City. <br />2. The City has approved the payment of IBC's reestablishment costs claim <br />in the amount of $50,000.00. This payment shall serve as full and final <br />payment of all eligible reestablishment costs IBC has incurred as a result <br />of being displaced by the City. <br />3. IBC acknowledges that it was represented in this matter by its own <br />attorney, Barbara M. Ross, and has been fully informed of the contents <br />and the implications of this Agreement by Ms. Ross. <br />4. IBC acknowledges that it has had ample opportunity to speak with the <br />relocation consultant retained by the City, Jon Morphew from Schnitker <br />Law Office, P.A., regarding the contents and implications of this <br />Agreement and the relocation advisory services, claim assistance, benefits <br />and payments for which it is eligible under the Uniform Relocation <br />Assistance and Real Property Acquisition Policies Act of 1970, as <br />amended, 49 C.F.R 24 and as adopted by the State of Minnesota via Minn. <br />Stat. §117.52.. <br />5. IBC willingly and voluntarily agrees that the payments referenced in <br />Paragraphs #1 and #2 above, shall serve as full and final payment of all <br />eligible relocation expenses for which it is eligible under the Uniform <br />Relocation Assistance and Real Property Acquisition Policies Act of 1970, <br />as amended, 49 C.F.R 24 and as adopted by the State of Minnesota via <br />Minn.
