Section 3 <br />Change the text of Section 803.030 as shown: <br />802.030. APPLICATION. Any person desiring a license to engage in the <br />business of dealing and /or selling Tobacco Products shall first make application <br />therefor to the Council of the City by filing with the City Administrator for <br />presentation to the Council an application in writing, which application shall set <br />forth the name and place of residence of the applicant and the exact location of <br />the place at which the applicant proposes to carry on said business. An <br />application to renew a Tobacco Store license shall include sufficient financial <br />information to show com liance with the reeuirement that 90% of cross revenue <br />derived from the sale of approved products. Said application shall be signed by <br />the applicant in person, and when received by the City Administrator shall be <br />placed on file; provided, however, that no such application shall be received <br />unless it is accompanied by the payment of a fee as provided for herein. <br />Section 4 <br />Change the text of Section 802.070 as shown: <br />802.070. LICENSE RESTRICTIONS. A license shall be issued subject <br />to the following restrictions: <br />(a) The following restrictions apply to premises licensed as a Tobacco <br />Store: <br />(1) Indoor sampling of tobacco permitted by the Minnesota <br />Clean Indoor Air Act (Minn. Stat. 8 144.4167 must be <br />limited to the sample quantity as defined in this Ordinance. <br />The store must comply with the Clean Indoor Air Act in all <br />other respects. <br />(2) No person shall ermit a minor to sample tobacco. <br />(3) Tobacco samples must be lit by an employee of the store <br />who must remain with the customer while the sample is <br />consumed. <br />(4) The store's operating hours may start no earlier than 8:00 <br />A.M. and must end prior to 10:00 P.M. If a land use permit <br />or restrictive covenant also contains provisions relating to <br />operating hours, the more restrictive regulation shall apply. <br />5 <br />
