(5) No more than 15% of the total product display area in the store may be used for the display or storage of tobacco - related devices. (b) The following restrictions apply to premises licensed for general tobacco sales and display: 1 No sam.lin• of tobacco is allowed on the .remises and the establishment shall fully comply with the Minnesota Clean Indoor Air Act, Minn. Stat. $ 144.411 to 144.417. There shall be no dis.la of tobacco - related devices for sale on the licensed premises, whether the sale is for the benefit of the licensee or for a third party (e.g. consignment). (3) Other than Tobacco Products packaged in cartons containing at least ten (10) individually packaged Tobacco Products, a licensee shall not offer for sale or otherwise dispense any Tobacco Product by self - service merchandising. (c) The following restrictions apply to all licenses: (1) Vending machines used to dispense Tobacco Products shall be prohibited unless the following conditions are met: (i) The vending machine shall be operable only by the activation of an electronic switch operated by an employee of the licensee before each sale, or by insertion of a token provided to the purchaser by an employee of the licensee; and (ii) The vending machine shall be located in the immediate vicinity, plain view and control of a responsible employee of the licensee, so that all purchases will be readily observable by the employee of the licensee. The vending machine shall not be located in a coatroom, restroom, unmonitored hallway, outer waiting area or similar unmonitored areas. The vending machine shall be inaccessible to the public when the establishment is closed.
