MINUTES <br />CITY COUNCIL <br />APRIL 27, 2011 <br />Boss suggested that in addition to defining sample size, the ordinance <br />should limit the number of samples that a customer might try. The City <br />Attorney indicated that he felt such a restriction would be difficult to <br />enforce. He noted the requirement that a tobacco shop attendant must <br />light and remain with the customer while the sample is consumed is a <br />restriction that would likely address the concern that a number of samples <br />would be consumed by one customer. <br />The Council then discussed separation requirements, and Biesener felt that <br />those proposed in the model ordinance were acceptable. The City <br />Attorney indicated that separation requirements from schools was good, <br />but suggested that other separation requirements may not be helpful. A <br />distance separation between tobacco shops would be of help if the City <br />was trying to avoid one street becoming a location of numerous tobacco <br />shops. <br />The City Attorney indicated that there are a number of provisions in the <br />model ordinance which he feels should be added to the City's ordinance <br />amendment. He suggested that he redraft the proposed ordinance <br />incorporating these provisions, and submit a revised draft for the <br />Council's review at its next meeting. The Council agreed, and indicated <br />that once it finalizes the draft, then the tobacco license holders would be <br />invited to the following meeting at which their input would be heard prior <br />to adoption of the ordinance. <br />GRABA The City Administrator pointed out the earlier discussion relative to <br />LOAN the Graba Loan Agreement and the need to redraft the document if the <br />AGREEMENT Council is agreeable to Bob Wagner's proposal not to move Neato Scan <br />into his building at 3225 Country Drive. <br />Keis indicated that he did not understand the business model for the thrift <br />store that Wagner is proposing to move into the building. Keis pointed out <br />that Neato Scan is a viable business, while the thrift store is a start-up <br />venture with no guarantee that it will be successful. Keis stated that he did <br />not want to get into the business of telling Wagner who to lease to, but <br />pointed out that the Loan Agreement was predicated on Neato Scan <br />moving jobs into the City. <br />The City Administrator indicated that 3225 Country Drive would be fully <br />leased with the expansion of Athlete Fit and the addition of the thrift store. <br />The Administrator agreed that the viability of the thrift store is unknown. <br />The Administrator pointed out that the Loan Agreement was based on <br />Neato Scan moving into the building.
