MINUTES <br />CITY COUNCIL <br />APRIL 27, 2011 <br />COMPLIANCE WITH THE RECOMMENDATIONS OF THE CITY <br />PLANNER AS OUTLINED IN HIS REPORT DATED APRIL 7, 2011 <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />INCREASE IN Blesener opened the Public Hearing to consider an increase in the City's <br />ON -SALE On -Sale Liquor and On -Sale Wine License fees. <br />LIQUOR & <br />ON -SALE The City Clerk reviewed her report in which staff recommended a <br />WINE continuation of the 5 -year policy tying increases in the On -Sale Liquor <br />LICENSE and On -Sale Wine License fees to the percentage increase in the City's <br />FEES Gross Levy increase. The Gross Levy increase for the 2011 budget was <br />3.94 %, which would impact these liquor license fees as follows: <br />2010 Fee Proposed 2011 Fee <br />On -Sale Liquor $4,206 $4,372 <br />On -Sale Wine $608 $632 <br />The City Clerk noted that the City's On -Sale Sunday and Off -Sale Liquor <br />License fees are regulated by State Law and are at the maximum allowed. <br />Staff is proposing no increase in the 2 A.M. License, On -Sale 3.2 <br />Intoxicating Malt Liquor, or Off -Sale 3.2 Intoxicating Malt Liquor fees. <br />Tom Duray, Hoggsbreath, indicated that the increase proposed is a <br />moderate one, and the formula used by the City seems to be working. <br />Blesener noted that tying these increases to the Gross Levy increase was <br />based on a 5 -year policy, and this would be the 6th year. He asked if the <br />Liquor businesses in the City would support 5 year extension of that policy. <br />Duray stated that he did not discuss this with other liquor businesses in the <br />City. He suggested that if there were major objections, there would have <br />been owners present this evening. Duray stated that he would like the <br />increase considered on an annual basis so that liquor businesses have the <br />opportunity to comment should there be some changes in the business <br />climate. Blesener noted that the City must hold a public hearing whenever <br />it changes these license fees, therefore, businesses would have the <br />opportunity to comment. He further noted that the plan to tie license <br />increases to the gross levy increase was a means of providing for smaller <br />license fee increases on an annual basis, rather than the City trying to <br />catch up and imposing a big increase in one year. <br />14 <br />
