MINUTES <br />PLANNING COMMISSION <br />MAY 12, 2011 <br />• The applicant has shown practical difficulties in complying with <br />the strict terms of the ordinance, which would otherwise prohibit <br />this manner of use. <br />Motion seconded by Knudsen. <br />Motion carried 7 — 0. <br />TEXT The City Planner reported that the City's Parks & Recreation Department <br />AMENDMENT is requesting a Text Amendment to the Zoning Code to add seasonal <br />& PUD garden centers and farmers' markets as a conditional use in the General <br />PERMIT — Business (B -3) District as well as a PUD Permit for the operation of a <br />FARMERS' seasonal farmer's market at the Saxon Lanes property at 61 West Little <br />MARKET Canada Road. The Planner explained that the Saxon property is zoned <br />PUD District. Uses allowed in the PUD District include those specifically <br />listed in the district itself, as well as those uses in the City's business <br />districts. Given that farmers' markets are not an allowed or conditional <br />use in any of the business districts, the Text Amendment would make that <br />use a conditional use in the B -3 District, which would then be a use <br />allowed by PUD Permit in the PUD District. The Planner noted that he is <br />also suggesting that seasonal garden centers be added to the B -3 District as <br />well. The Planner noted that seasonal garden centers have typically <br />utilized some semi - permanent structures. The farmers' market, however, <br />would not. <br />The Planner noted that the Parks Department is proposing to operate the <br />farmers' market on Mondays from June 20 through September 26`x', from <br />9 a.m. to 1 p.m. 1-Ie noted the vendor regulations and handbook that has <br />been prepared by the Parks Department. The Planner indicated that the <br />Parks Department has modeled this market after one that has operated in <br />Shoreview for a number of years. <br />The Planner indicated that the Parks Department has requested one <br />change. The Department has indicated that it is typical to have some craft - <br />type items for sale at farmers' markets. The Planner noted that the <br />ordinance was drafted to restrict the goods sold to produce, food products, <br />and garden vegetation in order to eliminate a flea market operation. The <br />Planner felt, however, that allowing up to 25% of the goods to be sold to <br />craft items would accommodate the non -food vendors that are typical at <br />farmers' markets. <br />The Planner reported that the Parks Department has applications from <br />about 12 vendors at this time. The Department will review these <br />applications to ensure that there would be compliance with the 25% <br />-6- <br />
