AGREEMENT <br />This agreement is made and entered into this day of May, 2011 by and between <br />Vance Johnson, a single person, hereinafter referred to as "Owner" and the City of Little <br />Canada, a Minnesota Municipal Corporation, hereinafter referred to as "City ". <br />WITNESSETH: <br />The City is proposing to remedy code violations found to exist on Owner's property <br />located at 304 County Road B2, as outlined in the City's April 27, 2011 letter to Owner <br />(copy attached hereto as Exhibit A). The property is legally described as: <br />Subject to McMenemy Street, County Road B2, State Trunk Highway 36/118 and <br />Gas Pipe Line Easement T E, the East 800 Ft of the part of the Southeast Vi of Section <br />7, Township 29, Range 22N lying North of Viking Drive. <br />And is further identified by Property Identification Number 07- 29 -22 -41 -0001 <br />The City Fire Marshal has recommended abatement of the violations documented in <br />the April 27, 2011 letter, as he has determined it is in the public's best interest to have the <br />violations corrected forthwith in order to correct the unsafe and hazardous conditions now <br />existing on the property. The conditions at the property are sufficiently severe to warrant an <br />order of the City Council directing abatement of the hazardous condition, potentially leading <br />to a court- ordered removal of the hazardous conditions with the costs of said removal <br />assessed to the property. <br />In the spirit of cooperation and to provide the owner the opportunity to <br />voluntarily remedy the violations existing upon the property in lieu of abatement by the <br />City, the City and the Owner hereby agree to the following terms and conditions: <br />1. Consent to Abatement; Forbearance. Owner acknowledges the hazardous <br />conditions upon his property and agrees that the conditions must be addressed. Owner <br />hereby consents, pursuant to Minnesota Statutes, § 463.151, to the City's removal of any <br />hazardous conditions on the property, and recover costs for same, without need of a district <br />court order authorizing the removal action. In exchange for Owner's voluntary consent, City <br />agrees that it will not issue an Order for abatement, seek a court order authorizing removal of <br />hazardous conditions, or pursue any related action against the property while Owner is <br />complying with the voluntary cleanup plan outlined in this Agreement. <br />
