Fees also felt that the current hours of operation <br />should not be a problem for the City. <br />Blesener asked when the majority of the customers visit the hookah <br />lounge. Nelson reported that most are there between 8 p.m. and 2 a.m. <br />Nelson reported that he is currently open from 5 p.m. until 2 a.m. <br />Nelson requested that if the Council amends the ordinance that his <br />business be grandfathered in under the current ordinance. He suggested <br />that if he sold or vacated the business, then any ordinance in place at that <br />time would apply. <br />Blesener suggested that there be no action on the ordinance this evening, <br />and felt it my be necessary to hold a workshop to discuss the matter <br />further. It was noted that current tobacco licenses expire on June 30th• <br />The City Administrator suggested that a shortened license period could be <br />put in place to allow the Council time to do additional work on the <br />ordinance amendment. The City Attorney indicated that he could prepare <br />an ordinance amendment creating the shortened license term. <br />Keis asked about freezing the number of tobacco license. It was pointed <br />out that the number is currently capped at 12, which is the number of <br />licenses currently active. The City Clerk reported that one license holder <br />has indicated that he will not be renewing his tobacco license. The <br />Council indicated that, in that case, the City Attorney should prepare an <br />amendment reducing the license cap to 11. <br />DeRosa asked the term of the shortened license. It was the consensus of <br />the Council that the term should be 6 months in order to give the Council <br />adequate time to review available options and do additional research. The <br />Council also asked that the City Attorney research the Legislature's intent <br />in not defining sampling. <br />The City Attorney indicated that he would have the ordinance amendment <br />to the Council for review at the June 8'h meeting. <br />RECESS At this point in the meeting, 9:48 p.m., Council took a short recess. The <br />meeting was reconvened at 10:00 p.m. <br />VANCE The City Administrator presented the Council with an agreement between <br />JOHNSON the City and Vance Johnson wherein Mr. Johnson will clean up his <br />AGREEMENT based on an agreed to timeline and work schedule. If that timeline and <br />work schedule is not met, the City can then abate the nuisance and assess <br />17 <br />
