MINUTES <br />CITY COUNCIL <br />MAY 25, 2011 <br />Saxon Lanes. He noted that this property is zoned PUD District, and <br />under the current zoning ordinance, there is no provision for a farmers' <br />market. The Planner further pointed that the uses allowed in a PUD <br />District are typically listed in other zoning districts. He indicated that a <br />Text Amendment is needed to list the farmers' market use somewhere in <br />the Zoning Code, which will then be allowed in the PUD District by <br />reference. <br />The Planner then reviewed the proposed Text Amendment adding <br />seasonal garden centers and farmers' markets by conditional use to the <br />B -3 Zoning District. He also revised the specific conditions that would be <br />required to be met in order to obtain a CUP for this use. <br />The City Planner noted that the City Engineer has made some <br />recommendations for moving the farmers' market site further west on the <br />property, which the Parks & Recreation Department has complied with. <br />McGraw noted that the Text Amendment allows for up to 25% of the <br />vendors to sell craft, art, or similar items. McGraw pointed out previous <br />discussion relative to flea markets, and suggested that some standard be <br />included in the proposed Text Amendment whereby the 25% maximum <br />for craft, art, etc. items can be measured. The City Planner stated that he <br />would modify that language accordingly. <br />Keis asked where the 25% maximum came from. The City Planner <br />reported that the City's Parks & Rec Department is modeling this farmers' <br />market after the one operated in Shoreview. The Shoreview farmers' <br />market is a fairly large one and has been very successful. The City <br />Planner reported that the City's Parks & Rec Department has an extensive <br />application process it is putting in place wherein it will be able to evaluate <br />the vendors requesting space at the market. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Keis, seconded by Montour, the public hearing was <br />closed. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2011 -5 -102 — APPROVING THE TEXT <br />AMENDMENT TO THE ZONING CODE ADDING SEASONAL <br />GARDEN CENTERS AND FARMERS' MARKETS ASA <br />CONDITIONAL USE IN THE GENERAL BUSINESS (B -3) ZONING <br />DISTRICT WITH THE CLARIFICATION THAT UP TO 25 % OF <br />6 <br />
