MINUTES <br />CITY COUNCIL <br />JULY 27, 2011 <br />REVISIONS <br />COAL <br />TAR -BASED <br />SEALANTS <br />amended lease also contains a rent escalation clause of 4% per year. The <br />Administrator noted that the revised lease before the Council this evening <br />is the result of some antenna changes that A T & T is proposing, and <br />clarifies that A T & T will stay within the 9 antennas that they are <br />authorized under the current lease. <br />The Administrator reported that if A T & T merges with T- Mobile, the <br />City will likely lose the T- Mobile revenue from their water tower lease at <br />some point in the future. The Administrator indicated that there is some <br />move in the US Senate in opposition of this merger. <br />The Administrator stated that the lease amendment is in standard form, <br />and he recommended approval. <br />Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2011 -7 -141— APPROVING THEAMENDEDA T <br />& T LEASE AGREEMENT AS RECOMMENDED BY THE CITY <br />ADMINISTRATOR AND AUTHORIZING THE MAYOR AND CITY <br />ADMINISTRATOR TO EXECUTE ON BEHALF OF THE CITY <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />The City Administrator presented the Council with a proposed <br />ordinance prohibiting the use and sale of coal tar -based sealants in the <br />City of Little Canada based on the Council's discussion at its last meeting. <br />The Administrator noted that the ordinance is based on the State model <br />which does not impact retailers by requiring the documentation of sales <br />information. It was noted that the majority of retailers do not sell sealant <br />products that are coal tar- based. It is typically some of the driveway <br />companies that use these products. The Administrator noted that <br />pollutants from coal tar -based sealants get into ponds and negatively <br />impact the environment. <br />Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2011 -7 -142 — ADOPTING AN ORDINANCE <br />REGULATING THE USE OF COAL TAR -BASED SEALER <br />PRODUCTS WITHIN THE CITY OF LITTLE CANADA <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (5). <br />10 <br />
