MINUTES <br />CITY COUNCIL <br />JULY 27, 2011 <br />CUP <br />PERMITS — <br />87/87 COUNTY <br />ROAD C — <br />PRESTIGE <br />POOLS <br />Blesener opened the Public Hearing to consider the request for <br />Conditional Use Permits to allow a commercial use (pool <br />construction, service, and retail sales business) in the Residential - <br />Business (R -B) District as well as construction of a 1,200 square <br />foot garage for storage of business - related materials and supplied <br />at 87/89 County Road C, Pat Henry, Prestige Pools. The City Planner and <br />the Planning Commission have recommended approval subject to <br />conditions. <br />The City Planner indicated that commercial uses are allowed in the R -B <br />Zoning District by Conditional Use Permit (CUP). Construction of an <br />accessory building in the R -B District also requires a CUP. The Planner <br />indicated that the R -B District is a transitional zone that allows business <br />uses that are compatible with residential neighborhoods. The applicant is <br />proposing to locate his business on the former Corner Coffee House <br />property. The business will consist of office, limited retail, and storage <br />uses pertaining to a pool business. The Planner noted that the applicant is <br />proposing to construct a 1,200 square foot garage to store all equipment <br />and materials, and has proposed to move the garage approximately 20 feet <br />to the north. This location meets code requirements, and the garage also <br />meets setback requirements. <br />The Planner stated that the use is appropriate given the requirements of the <br />RB District, and the conditions recommended for approval. The Planner <br />stated that the recommended conditions are primarily architectural in <br />nature and related to the garage building. He noted that the garage will be <br />visible from Rosewood Drive, a residential street. Therefore, the <br />recommendations for an increased roof pitch to match the principle <br />structure as well as the addition of false dormers on the garage, will ensure <br />a more residential appearance for the neighborhood. The appliance has <br />indicated that the color of the garage and the siding will match the <br />principle building. The Planner also noted that all materials and <br />commercial vehicles will be parked inside as required in the R -B District. <br />The Planner stated that with the conditions outlined in his report, he would <br />recommend approval. <br />Pat Henry, Prestige Pools, reported that there is a 12/12 pitch on the house. <br />In order to park vans inside the garage, a 9 foot side wall is required. <br />Henry indicated that it would not be possible to have a 12/12 pitch with <br />the 9 foot side walls and still maintain roof height at a maximum of 15 feet <br />at the mid - point. Henry anticipated that either a 6/12 or 8/12 pitch would <br />work, however. <br />4 <br />
