The Metropolitan Council proposes to build a park and ride facility on a 4 acre site that <br />is within the right of way of MnDOT's Trunk Highway 36. This parking facility itself <br />covers approximately 2.5 acres with a 5,100 square foot filtration basin. It will contain a <br />total of 278 parking spaces. The east side of the site will contain a 9' x 18' bike shelter, <br />a 10.5' x 12' restroom facility, and a 6' x 28' bus shelter. <br />The zoning standards apply generally to development on private property, and do not <br />translate specifically to public improvements within the right of way. As such, the <br />primary analysis will be whether the facility meets the general conditional use criteria <br />through compatibility with the area, and avoiding the creation of congested conditions in <br />the area. <br />The conditional use permit criteria for this use including the following <br />Section 912.04.A Public regulated utility buildings, public garage, public utility <br />cabinets or infrastructure, and/or similar structures which are necessary for the <br />health, safety and general welfare of the community <br />1. Conformity with the surrounding neighborhood is maintained and <br />required setbacks and side yard requirements are met. <br />• The setbacks for this particular use do not apply, since the improvements <br />are public elements within the right of way. <br />2. Equipment is completely enclosed in a permanent structure with no <br />outside storage. <br />• No equipment is being stored on the site. <br />3. Adequate screening and landscaping from neighboring residential <br />districts is provided in accordance with Section 903.020.G of this <br />Ordinance. <br />• Screening is not necessary because the site in not adjacent to any <br />residential lots. Landscaping is shown within the plan to be sufficient for <br />the standards of an off site parking facility however approval should be <br />pending the city engineer's review. <br />4. The provisions of Section 921.010.0 of this Ordinance are considered <br />and satisfactorily met. <br />Section 921.010.0 <br />1. The applicant shall demonstrate by clear and convincing evidence <br />that the proposed action has been considered in relation to the <br />specific policies and provisions of and has been found to be <br />consistent with the official City Comprehensive Land Use Plan. <br />• The proposed plan does appear to be consistent with the goals and <br />policies of the transportation and land use sections of the comprehensive <br />plan in provision for transit. <br />2. The applicant shall demonstrate by clear and convincing evidence <br />that the proposed site is or will be compatible with present and <br />future land uses of the area. <br />58 <br />
