MINUTES <br />CITY COUNCIL <br />APRIL 14, 2004 <br />Montour asked if access through County Road D would be maintained. <br />Pafko replied that that would depend on the condition of the County Road <br />D roadwork. <br />With regard to the issue of municipal consent for the Unweave the Weave <br />project and the imposition of conditions by the City, Pafko reported that <br />the Attorney General has indicated that unless MN DOT is in agreement <br />with every word of any conditions, a municipal consent with conditions is <br />treated as a denial. Therefore, Pafko requested that the Council act on two <br />separate resolutions for the Unweave the Weave project. One resolution <br />would provide municipal consent. The other resolution would list the <br />issues that the City and MN DOT will continue to work on as relates to the <br />project. Pafko reported that a municipal consent with conditions will <br />likely force the appeal process. <br />Fahey noted that Pafko has indicated MN DOT is agreeable to some of the <br />conditions listed. He felt, therefore, that the municipal consent should <br />contain those conditions. <br />Pafko noted that any conditions contained in the municipal consent would <br />have to be reviewed by MN DOT staff. Therefore, at this time, he could <br />not guarantee that the appeal process would not be triggered by those <br />conditions. <br />It was noted that the City of Vadnais Heights has granted municipal <br />consent with conditions. Pafko reported that he has not received the final <br />resolution from Vadnais Heights, therefore, is unsure whether the <br />conditions imposed would trigger the appeal process. <br />Pafko continued the issues review, pointing out that the earlier discussion <br />on the Cooperative Drainage Improvements. <br />Fahey indicated that the regular Council meeting is scheduled to begin at <br />7:30 p.m.; therefore, this discussion will be continued into that meeting. <br />The workshop meeting was adjourned at 7:30 p.m. <br />Attest: <br />Michael I.
