downstream of On- Site's connection. A letter from Mr. Holm explaining their position is <br />also included with this material. In this letter, Mr, Holm has stated that On -Site <br />Sanitation would he willing to purchase additional insurance and name the City of Little <br />Canada as a loss payee in the event of a backup. Staff also had verbal discussions with <br />Mr. Holm regarding On -Site indemnifying the City against future claims. <br />Staff will be recommending that the Disposal Site Use Permit for On -Site Sanitation not <br />be renewed. If the final decision is to not renew, then On- site's Disposal permit will <br />expire on May 31, 2008. Another issue to be determined should we not renew the permit <br />is determining how the site is closed off for dumping. I have been in contact with Mr. <br />Pierson of the Metropolitan Council and their position is this is a matter between the City <br />and the company. We will need to inform them of our decision so they can make the <br />appropriate changes in their permit language to reflect On -Site Sanitation's disposal <br />status. <br />From a process standpoint, staff is recommending the Council call for a public hearing to <br />consider this issue. The purpose of the hearing is to provide for due process <br />considerations on behalf of On -Site, including their right to present information on their <br />behalf Staff is recommending the hearing be held at our next meeting on February 27". <br />We would recommend notifying all property owners within 350 feet of this use, <br />cc: Mr. Dave Holm, On -Site Sanitation <br />Mr. Mark Pierson, Metropolitan Council <br />4 <br />
