815. LAWFUL GAMBLING <br />815.010. LAWFUL GAMBLING. The City of Little Canada hereby reserves all rights to <br />regulate lawful gambling, as provided in Chapter 349 of the Laws of the State of Minnesota, and all <br />subsequent amendments thereto, including the right to approve premises permits or bingo hall <br />licenses for lawful gambling subject to whatever conditions the City Council deems necessaty to <br />protect the public health, safety, and welfare. Lawful gambling is permitted in the City of Little <br />Canada if the organization conducting the lawful gambling meets the following criteria: <br />1. Meets the requirements of Minn. Stat. Sect. 349.16(b) through (h) and is duly <br />licensed by the Minnesota Gambling Control Board. <br />2. Has maintained an address within the City for at least three years prior to the <br />application. This requirement may be waived for an existing organization which <br />does not comply with this requirement if approved by the City Council at the time of <br />the license renewal immediately subsequent to the passage of this Ordinance. <br />3. Complies with all of the provisions of this Ordinance and State law. <br />4. Provides confirmation that no officer or member of the govern ing body of the <br />organization has been convicted in State or Federal Court of a felony or gross <br />misdemeanor within five (5) years immediately prior to the issuance of the license or <br />has ever been convicted of a crime involving gambling or has had a license issued by <br />the Board or Director revoked for violation of Law or Board Rule regulating lawful <br />gambling. <br />5. Provides confirmation that no director, member of the governing body, employee or <br />consultant of the organization has been convicted in State of Federal Court of a <br />felony or gross misdemeanor involving theft, dishonesty or false statement, or <br />involving the sale or possession of a controlled substance within five (5) years <br />immediately prior to the issuance of the license or has ever been convicted of a crime <br />involving gambling or has had a license issued by the Board or Director revoked for <br />violation of Law or Board Rule regulating lawful gambling. <br />815.015. NUMBER OF LICENSES AND PERMITS. <br />(A) The maximum number of bingo hall licenses within the City shall be one (1). The <br />license shall be limited to the location and to the owner specified on a license. Any <br />change of location or ownership without <br />the approval of the City shall result in the termination of the license. <br />(B) The maximum number of Class A premises permits for one location shall be five (5). <br />The Class A permits shall terminate simultaneously with the termination of the <br />bingo hall license. <br />815 -1 <br />7 <br />
