AGREEMENT BETWEEN <br />CITY OF MAPLEWOOD <br />AND <br />CITY OF LITTLE CANADA <br />SANITARY SEWER USE /CONNECTION AGREEMENT <br />This Agreement, made and entered into this day of , 2008, by <br />the City of Maplewood (hereinafter "Maplewood "), a municipal corporation of the State <br />of Minnesota and the City of Little Canada (hereinafter "Little Canada "), a municipal <br />corporation of the State of Minnesota. <br />RECITALS <br />WHEREAS, Little Canada has requested permission from Maplewood to connect <br />a portion of its public sanitary sewer system to the Maplewood sanitary sewer system for <br />the purpose of transporting sanitary sewage from Little Canada into Maplewood's Sewer <br />District 13, and the following agreement is intended to reflect the mutual understanding <br />and agreement to accomplish this purpose. <br />NOW, THEREFORE, in consideration of the mutual covenants and promises <br />made herein, the parties agree as follows: <br />SECTION 1 <br />TERMS <br />1) Maplewood does hereby grant permission to Little Canada to connect <br />Little Canada's sanitary sewer to convey sanitary sewage from Little <br />Canada to Maplewood's Sewer District 13 at the intersection of Kohlman <br />Lane and Beam Avenue. <br />2) The Little Canada sewer system to be connected to the Maplewood sewer <br />system shall be used solely for the purpose of conveying sanitary sewage <br />and Little Canada shall not permit or allow any storm water runoff to enter <br />the sanitary sewer system. Additionally, it is understood that Maplewood <br />may conduct periodic metering of flows. If it is determined that Little <br />Canada is contributing inflow /infiltration of storm water into the sanitary <br />sewer system, Little Canada shall take immediate steps to eliminate the <br />inflow /infiltration. Little Canada also agrees to reimburse Maplewood the <br />applicable Metropolitan Council Environmental Services treatment <br />charges associated with the estimated inflow and infiltration generated <br />from sewer lines originating in Little Canada. Little Canada may install a <br />meter in the line immediately prior to Little Canada's flow entering <br />13 <br />
