Maplewood's Sewer District 13 at Kohlman Lane and Beam Avenue as <br />the basis for prospective charges. <br />3) Little Canada shall be fully responsible to pay all costs associated with the <br />extension of the Maplewood sanitary sewer main from the intersection of <br />Kohlman Lane and Kohlman Court to north of the intersection of <br />Kohlman Lane and Beam Avenue. Costs for this work will be billed to <br />Little Canada by Maplewood under Maplewood City Project 07 -21. This <br />sanitary sewer main is being installed for anticipated need by Little <br />Canada to service future development north of Beam Avenue. Little <br />Canada shall be fully responsible for future maintenance, repair, and <br />replacement costs along with all associated restoration costs for this deep <br />sanitary sewer main, located within Maplewood's Kohlman Lane <br />extending northerly, into Little Canada, from the sanitary sewer manhole <br />located at the intersection of Kohlman Lane and Kohlman Court. Little <br />Canada also agrees to pay Maplewood for all street and utility <br />reconstruction work under Maplewood City Project 07 -21, that directly <br />benefits Little Canada, specifically the work north of the Beam Avenue <br />center line. <br />4) Little Canada and Maplewood shall each be responsible for the <br />maintenance and repair of their respective sanitary sewer systems. Little <br />Canada agrees to hold harmless, indemnify, and defend Maplewood from <br />any and all claims for damages to persons or property arising from <br />intentional misuse or negligent use, operation, or maintenance of the <br />sewers that are owned and maintained by Little Canada and authorized to <br />be connected to the Maplewood sanitary sewer system pursuant to this <br />agreement. Maplewood agrees to hold harmless, indemnify, and defend <br />Little Canada from any and all claims for damages to persons or property <br />arising from intentional misuse or negligent use, operation or maintenance <br />of the sewers that are owned and maintained by Maplewood. Under no <br />circumstances, however, shall a party be required to pay on behalf of itself <br />and other parties, any amounts in excess of the limits on liability <br />established in Minnesota Statutes Chapter 466 applicable to any one party. <br />The limits of liability for some or all of the parties may not be added <br />together to determine the maximum amount of liability for any party. <br />SECTION 2 <br />BILLING <br />After development in Little Canada has commenced and sewer connections have <br />been made to Maplewood's sanitary sewer lines in Maplewood's Sewer District <br />13, Maplewood shall bill Little Canada the maintenance of the sanitary sewer line <br />from Little Canada to Maplewood's Lift Station 14 and Maplewood's Lift Station <br />17 based on the percentage of flow from Little Canada.
