MINUTES
CITY COUNCIL
JANUARY 27, 1999
fencing for those properties on the north side of the street. He
would also plant vines along these fences. With regard to a license
fee, Frattalone proposed 10 cents per yard of recycled material,
which he estimated would amount to between $6,000 and $10,000
per year. Frattalone proposed that this money be put toward
landscaping and cleaning up Ryan Industrial Park, and indicated
that he would be willing to work with the Code Enforcement
Officer to get this done.
Fahey stated that he supported the recommendation of the City
Attorney to clean up this situation from a legal standpoint. Fahey
proposed that the interim use be established for a 10 -year period,
although he indicated that he could support a longer time period.
LaValle suggested 15 years.
Scalze pointed out that whatever is done for Frattalone will affect
other properties in the area.
Fahey suggested that the interim use be limited to the existing
owner, with the use to cease if ownership of the property changes.
Fahey pointed out that the City knows the type of operation that
Frattalone operates.
The City Administrator suggested that there would be a
development agreement that would coincide with the interim use
ordinance. This development agreement would address issues of
transfer of the property, license fee, etc.
LaValle suggested the interim use be allowed for a 15 -year period.
Fahey suggested that in 10 years the City should know where the
recycling business is at. Morelan stated that a 10 -year period was
acceptable to him. Fahey suggested that the City Attorney and
staff work out the details and present a recommendation to the
Council.
Frattalone asked if development agreement would allow the
interim use to be re- applied for at the end of whatever the time
period is set at. Fahey replied that it could. Fahey also suggested
that the development agreement provide for the recession of the
use should the ownership of the business change.
Mr. Morelan introduced the following resolution and moved its
adoption:
17
26
