DEVELOPMENT CONTRACT <br />AGREEMENT dated hey/ 19 0, by and between the <br />CITY OF LITTLE CANADA, a Minnesota Municipal Corporation ( "City ") <br />and FRATTALONE EXCAVATING, a Minnesota Corporation ( "Developer "). <br />1. Request for Approval for a Temporary Aggregate <br />Materials Storage and Processing Permit (the "Permit "). The <br />Developer has asked the City to approve a Temporary Aggregate <br />Materials Storage and Processing Permit for land legally <br />described as attached in Exhibit A. <br />2. Conditions of Approval. The City hereby approves the <br />Permit on condition that the Developer enter into and guarantee <br />compliance with the terms of this agreement and furnish the <br />security required by it. <br />3. Compliance with Laws and Regulations. The Developer <br />represents to the City that to the best of his knowledge the <br />Property will comply with all county, metropolitan, state and <br />federal laws and regulations, including, but not limited to <br />environmental regulations. If the City determines that the <br />Property does not comply as approved, the City may, at its <br />option, refuse to allow any work on the Property until the <br />Developer does comply. Upon the City's demand, the Developer <br />shall cease work until there is compliance. Notwithstanding <br />anything in this Contract to the contrary, to the full extent <br />permitted by state law, the City may require compliance with any <br />amendments to the City's Comprehensive Pan, zoning, platting or <br />dedication requirements enacted after the date of this Contract. <br />4. Development Exhibits. The Developer shall operate the <br />Property in accordance with the plans shown on the following <br />exhibits. Developer shall provide said exhibits and all exhibits <br />must be approved by the City prior to their inclusion in this <br />Contract. If the exhibits vary form the written terms of this <br />Contract, the written terms shall control. The exhibits are: <br />Exhibit A - Legal Description <br />Exhibit B - Site Development Plan <br />Exhibit ,C - Erosion Control Plan <br />5. License. The Developer hereby grants the City, its <br />agents, employees, officers and contractors a license to enter <br />the Property to perform all necessary inspections deemed <br />appropriate by the City during the operation of the material <br />storage and processing by the Developer. The license shall <br />expire after the cessation of activities pursuant to the <br />Development Contract. <br />2 <br />
