Memo 11.1 11111% . - 11“0(1 -ATES TO: Honorable Mayor and City Council Members FROM: Lee Elfering, City Engineer DATE: May 17, 2007 RE: Ramsey County CIPR Cooperative Agreement Revision In April of this year we requested that the City Council approve entering into a Cooperative Agreement with Ramsey County for the Cold In -Place Recycling (CIPR) of Viking Drive from station 16 +50 to 38 +75 in the City's 2007 Street Improvements Project contingent on final revisions from City Staff. After bringing the agreement to the City Council the County informed our staff that the County Attorney had requested some revisions to the agreement and a new agreement would need to be processed. Attached is that revised agreement. In short, three revisions were made. The first revision was the inclusion of an anticipated timeline for the work to be completed. This was a request by our office to help coordinate the work the County would be completing and the work that will be completed by our 2007 Project Contractor. The second change was the removal of the estimated cost. The estimated costs were only included originally to give the City an idea of the expected cost, but had no bearing on how much the City would actually be billed. The original agreement, along with this new agreement, outline that the work will be done and paid for on a time and material basis. We do not have a concern with the removal of the estimated cost due to the fact that it has no bearing on the actual final cost. The final revision added requires the City to make payment to the County within 30 days of the invoice they will provide. This is fairly standard term of payment. We forwarded a copy of the revised Cooperative Agreement to the City Attorney for review and based on voicemail correspondence, it does not appear there are any legal issues from their standpoint regarding the agreement. Therefore we would recommend the City Council approve and enter into this Cooperative Agreement with Ramsey County for the CIPR of this section of Viking Drive. The County has indicated that they will be sending over the completed agreement that has been signed by the County Board for City signature.
