Mayor and City Council <br />April 25, 2007 <br />Page 2 <br />Therefore, without need for any CUP, the owner can conduct automobile repairs, parking for <br />company trucks and trailers, off - street truck and trailer loading and off - street parking and off - street <br />loading. Thus, it is not a significant leap to provide outdoor storage consistent with these permitted <br />uses. <br />The City's planning consultant, Northwest Associated Consultants, Inc., has prepared a staff report <br />dated January 5, 2007. This report indicates that the Property substantially complies with the <br />conditions set out in the I -I District for issuance of a conditional use permit, both for retail auto <br />sales and for outdoor sales. In those instances where there is not full compliance with the <br />conditions for issuance of the CUP, most municipalities will condition issuance upon satisfaction <br />with reasonable conditions. <br />The following is a review of the Property's substantial compliance with conditions for the issuance <br />of the CUP based upon the planning consultant's findings contained in the report dated January 5, <br />2007. <br />1. Retail Auto Sales CUP <br />a. Outside services and sales are associated with a principal building of at least one <br />thousand (1,000) square feet of floor area. <br />The planning consultant indicates that the use complies with this condition. <br />b. The entire sales lot and off - street parking area is paved. <br />The City has allowed some storage areas to remain unpaved in this District, but <br />those areas reserved for sales, parking and circulation need to be paved. <br />Further, the City can condition the CUP upon reserving paved areas for sales, <br />parking and circulation. <br />c. A minimum of three hundred eighty (380) square feet of sales area per vehicle is <br />provided. <br />The planning consultant indicates compliance with this requirement. <br />d. Adequate off - street parking and off - street loading in compliance with the <br />requirements of Sections 903.050 and 903.060 of this Ordinance is provided. <br />The planning consultant indicates that his requirement is satisfied. <br />e. A perimeter curb is provided around the sales /parking lot. <br />The City can condition its approval upon installation of curbing. <br />f. A strip of not less than five (5) feet adjacent to the public right -of -way shall be <br />landscaped and screened in compliance with Section 903.020.G of this Ordinance. <br />- 2 1 - <br />
