Mayor and City Council <br />April 25, 2007 <br />Page 3 <br />g• <br />Landscape plans for the proposed development shall be submitted to and approved <br />by the City Council and the City staff. <br />The City can condition approval of the CUP upon completion of the landscape <br />plan. <br />No more than a total of two (2) motor vehicle sales lot licenses may be in full force <br />at any one time in the B -2 and B -3 Districts, nor may more than a total of four (4) <br />such licenses be in force at any one time in the B -2, B -3, B -4, and I -1 Districts <br />combined. <br />The planning consultant notes that the applicant is applying for a text <br />amendment to this requirement to increase the number of available licenses to <br />five (5). It is noteworthy that the City allowed five (5) motor vehicle sales lot <br />licenses in the I -1 District for many years prior to the expiration of the <br />applicant's license late last year. Therefore, it is difficult to find a public health, <br />safety or welfare basis for limiting licenses to four, rather than the historical <br />five. <br />h. License shall be subject to an annual review. <br />The applicant has no objection to this condition. <br />2. Open and Outdoor Storage CUP <br />a. The area is fenced and screened from view of neighboring residential uses or <br />residentially zoned property. <br />This condition is not applicable since the property does not abut any residential <br />uses. This is noted by the planning consultant in the staff report. <br />b. Storage is screened from view of the public right -of -way. <br />The planning consultant notes that the current chain link fence with slats <br />appears to provide adequate screening. <br />c. Storage area is paved with asphalt, concrete, or other material approved by the City <br />Council. <br />The planning consultant notes that the City has permitted Class V gravel <br />surfaces for storage in this area. <br />d. All lighting shall be hooded and so directed that the light source shall not be visible <br />from the public right -of -way or from neighboring residential uses, and shall be in <br />compliance in Section 903.020.I of the Zoning Ordinance. <br />The City can condition the issuance of the CUP on submittal of a lighting plan. <br />- 2 2 - <br />
