Proposed Findings of Fact for Denial <br />1. Conditional Use Permit for retail motor vehicle sales lot <br />2. Conditional Use Permit for outdoor storage <br />3. Zoning Ordinance Amendment increasing the number of <br />outdoor motor vehicle sales licenses from four to five <br />Valor Enterprises <br />3161 — 3167 Spruce Street <br />Little Canada, MN 55117 <br />1. The subject property has a significant history of zoning violations, code <br />enforcement actions, and legal actions relating to the proposed use of the <br />property. <br />2. The proposed Conditional Use Permits and Text Amendment are proposing <br />the same use as in the past, and the application materials indicate that no <br />changes to the site or building are proposed. <br />3. The proposal in not consistent with the zoning ordinance requirement that <br />Conditional Use Permits and Amendments demonstrate compliance with the <br />Comprehensive Plan goal to "enhance" the community through architecture, <br />site planning, and other improvements. <br />4. The proposal in not consistent with the Comprehensive Plan goal to limit the <br />negative impacts of outdoor storage. <br />5. The proposal is not consistent with the Comprehensive Plan policy to limit <br />aesthetic impacts of outdoor storage through screening and landscaping. <br />6. The proposal is not consistent with the Comprehensive Plan policy to <br />enhance community character. <br />7. The proposal is not consistent with the Comprehensive Plan policy to <br />minimize, or potential eliminate, outdoor storage. <br />8. The proposal is not consistent with the zoning ordinance requirement for <br />consistency with neighboring land uses due to past and current efforts to <br />conform to existing permit requirements and zoning regulations. <br />9. The proposal is not consistent with the zoning ordinance requirement for <br />consistency with all zoning performance standards. <br />10. The proposal is not consistent with the zoning ordinance requirement that the <br />applicant demonstrate no depreciation of neighboring property values. <br />11. The proposal threatens the general welfare of the community through its use <br />of public resources in inspection, enforcement, and prosecution of the history <br />of violations attendant to the proposed Conditional Use. <br />
