CONCLUSION <br />HOM furniture is requesting a number of approvals to allow a home furniture store and <br />other retail tenants in a building previously occupied by Levitz. Requested approvals <br />include a Conditional Use Permit for a Comprehensive Sign Plan, a Conditional Use <br />Permit for proof of parking, a text amendment to Section 903.110 regarding electronic <br />signs, a text amendment to Section 913.020 regulating permitted uses in the B -W, <br />Business Warehouse District and a variance to allow a pylon sign 52 feet in height. The <br />HOM furniture use is proposed in the north portion of the building, with flexible tenant <br />space in the south portion of the building. Potential users for the south portion of the <br />building include carpet sales, paint sales, home decor, cabinets, and tool sales. <br />SUMMARY AND RECOMMENDATION <br />In regard to the request for a text amendment to allow the proposed uses in the B -W, <br />Business - Warehousing District, the City has the following applications to consider: <br />1. Request for a text amendment to Section 913.020 regulating permitted uses in <br />the B -W, Business Warehouse District, based on a finding that the proposed <br />uses are consistent with the intent of the BW District. <br />Staff recommends approval of the proposed amendment, with language provided in the <br />amendment prepared and attached as Exhibit A. The proposed uses appear to be <br />consistent with the intent of the district, in that they require large buildings with ample <br />floor space to display and store their inventory. The amendment prepared limits <br />additional permitted uses to those requested by the applicant. <br />2. Request for a Variance from maximum sign height based on a finding that a <br />genuine hardship exists which prohibits the applicant from having reasonable use <br />of the property. <br />Staff does not recommend approval of the Variance request as presented. The <br />applicant has not demonstrated any hardship. The applicant has claimed that recent <br />improvements to adjacent freeways now limit visibility of the sight from passing traffic. <br />However, in its current condition, the building is visible from the freeway, as would be <br />the proposed wall signage and a freestanding sign of 25 feet. Staff recommends the <br />applicant reduce the height of the sign by 27 feet to come into compliance with the <br />ordinance. <br />Request for a Conditional Use Permit for a Comprehensive Sign Plan, based on <br />a finding that the propose use is consistent with the intent of the sign ordinance <br />and satisfies the conditions of approval. <br />Staff does not recommend approval of the Conditional Use Permit as presented. The <br />proposed signage exceeds the maximum of 3,812 square feet allowed by ordinance. <br />7 <br />
