If the City believes a Variance may be appropriate, staff offers the following alternative <br />options to the requested Variance: <br />1. Grant a Variance for the proposed LED price sign only. Require removal of the <br />high -rise sign. <br />2. Allow the construction of two pylon signs, both of which shall be required to meet <br />the height and area requirements for the site. <br />In regards to the request for rezoning from B -3, General Business to B -4, <br />Comprehensive Business, the City has the following options: <br />1. Motion to approve the rezoning from B -3 to B -4, based on a finding that the <br />proposed land use designation is consistent with the character of the surrounding <br />area and the intent of the Comprehensive Plan. <br />2. Motion to deny the rezoning from B -3 to B -4, based on a finding that the <br />proposed land use designation is not consistent with the character of the <br />surrounding area. <br />In regards to the request for a Conditional Use Permit to allow a motor fuel station in the <br />B -4 District, the City has the following options: <br />1. Motion to approve the Conditional Use Permit, based on a finding that the <br />propose use is consistent with the intent of the B -4 District and satisfies the <br />conditions of approval. <br />2. Motion to deny the request for a Conditional Use Permit, based on a finding that <br />the conditions of approval have not been met. <br />Staff recommends approval of the rezoning and Conditional Use Permit. A similar <br />rezoning was approved in 1999 for the adjacent Citgo motor fuel station. The site has <br />previously operated as a gas station, and this use was adequately supported by the <br />site. The B -4 zoning designation would allow a potential change to a non -gas station <br />commercial use in the future. <br />SUMMARY <br />Staff recommends approval of the Rezoning and CUP to allow the re- establishment of <br />the gas /convenience use on this site. Since the applicant is not proposing changes to <br />the building or site plan, the existing conditions may be "grandfathered" as they now <br />exist, with improvements to be made when other building or site plan changes are <br />proposed. <br />With regard to the signs, staff would recommend that all signage be brought into <br />conformance. To accomplish this, the applicant would need to revise the proposed sign <br />
