property include townhouse or condominium <br />development, the applicant may submit a mailing list of <br />property owners obtained from the managers or <br />homeowners association of the townhouse or <br />condominium development. <br />(b) Technical Assistance Reports. The City Administrator shall <br />instruct the appropriate staff persons to prepare technical <br />reports where appropriate, and provide general assistance <br />in preparing a recommendation to the City Council. <br />(c) Review by Other Commissions or Jurisdictions. The City <br />Administrator shall refer copies of the preliminary plat to <br />the Park Board, Watershed District, County, <br />Metropolitan, State or other public jurisdictions for their <br />review and comment, where appropriate and when <br />required. <br />(d) Planning Commission Action. The Planning Commission <br />shall make a recommendation to the City Council. If the <br />Planning Commission has not acted upon the preliminary <br />plat within sixty (60) days from the first meeting at <br />which the request was received, the Council may act on <br />the preliminary plat without the Planning Commission's <br />recommendation <br />(e) City Council Action. <br />(1) Public Hearing. The City Council, upon receipt of the <br />application, staff reports, and Planning <br />Commission recommendation, shall instruct the <br />City Administrator to set a public hearing from <br />public review of the preliminary plat. The <br />Council shall hold the hearing and make a written <br />finding of fact. The notice of such hearing shall <br />contain a legal property description, description <br />of request and map detailing property location, <br />and be published in the official newspaper at least <br />ten (10) days prior to the hearing. Written notice <br />of the hearing shall be mailed at least ten (10) <br />days prior to the hearing to all owners of property <br />within three hundred fifty (350) feet of the <br />boundary of the subject property. <br />Exceptions: In cases of simple subdivision (i.e. <br />dividing one parcel into two or combining two <br />parcels into one) the Council may, when deemed <br />appropriate, waive the requirement for public <br />hearing. <br />(2) If all requirements of this Ordinance and <br />requirements as additionally imposed by the <br />Planning Commission are complied with, the <br />9 <br />Change "from" to "for" <br />Change to "Minor Subdivision <br />or Administrative Lot <br />Combination" <br />
