complied with. <br />1001.060. EXCEPTIONS. When requesting a subdivision, if <br />the following condition or conditions exist, the City Administrator shall <br />exempt the subdivider from certain procedural provisions as directed in <br />this section. <br />(a) In the case of a request to divide a lot where the division is to <br />permit the adding of a parcel of land to an abutting lot or to <br />create two lots and the newly created property line will not cause <br />the other remaining portion of the lot, or any structures within <br />the subdivision, to be in violation with this Ordinance or the <br />Zoning Ordinance, then the City Administrator shall place the <br />request on the agenda of the Planning Commission for <br />recommendation to the City Council, subject to the City's <br />scheduling requirements. Said subdivision may be exempted <br />from other procedural or data requirements as deemed <br />appropriate by the City Administrator. <br />(b) In the case of a request to combine two or more lots of <br />record, where there exists a total of no more than one (1) <br />building on all lots subject to the request, and which request will <br />not cause other parcels or structures to be in violation of this <br />Ordinance or the Zoning Ordinance, then the City Administrator <br />may certify that the procedural requirements of the subdivision <br />ordinance do not apply to the request, exempting the subdivider <br />from the requirements for Planning Commission <br />recommendation and City Council approval. Such certification <br />shall be made within ten (10) days of the receipt of this request. <br />1001.070. SEPARABILITY. If any section, subsection, <br />sentence, clause or phrase of this Ordinance is for any reason found to <br />be invalid, such decision shall not affect the validity of the remaining <br />portions of this Ordinance. <br />1001.080. CONFLICT. <br />(a) Whenever there is a difference between minimum standards <br />or dimensions specified herein and those contained in other <br />official regulations, resolutions or ordinances of the City, the <br />most restrictive standards shall apply. <br />(b) Whenever a design feature, improvement, standard, or <br />technique is proposed in a plat that is not provided for in these <br />regulations, said design feature, standard or technique shall be <br />considered to be a "non- standard improvement." Non - standard <br />improvements are grounds for denial of a plat.
