located so as to create setback violations from other existing buildings, <br />structures, roads, driveways, public and /or private utilities or other <br />private or public improvements; right -of -way that results in violation of <br />the City's pipeline safety policy. <br />OUTLOT. A lot remnant or parcel of land left over after <br />platting, which is intended as open space or other use, for which no <br />building permit shall be issued. <br />OWNER. Includes the plural as well as the singular, and where <br />appropriate shall include a natural person, partnership, firm association, <br />public or quasi - public corporation, private corporation, or a combination <br />of them. <br />PARKS AND PLAYGROUNDS. Public land and open spaces <br />in the City of Little Canada dedicated or reserved for recreation <br />purposes. <br />PERCENTAGE OF GRADE. On street center line, means the <br />distance vertically from the horizontal in feet and tenths of a foot for <br />each one hundred (100) feet of horizontal distance. <br />PEDESTRIAN WAY. A public right -of -way or private <br />easement across a block or within a block to provide access for <br />pedestrians and which may be used for the installation of utility lines. <br />PIPELINE. A pipe with a nominal diameter of six (6) inches or <br />more that is used to transport hazardous fluids. For the purposes of this <br />definition, pipelines do not include sanitary sewer lines installed and <br />maintained by the City or other governmental agency, or an approved <br />private property owner. <br />PLANNING COMMISSION. The Planning Commission of <br />the City of Little Canada. <br />PRELIMINARY PLAT. A tentative drawing or map of a <br />proposed subdivision meeting the requirements herein enumerated. <br />PROTECTIVE COVENANTS. Contracts made between <br />private parties as to the manner in which land may be used, with the <br />view to protecting and preserving the physical and economic integrity of <br />any given area. <br />PUBLIC IMPROVEMENT. Any drainage ditch, roadway, <br />parkway, sidewalk, pedestrianway, tree, lawn, off - street parking area, <br />lot improvement, or other facility for which the City may ultimately <br />assume the responsibility for maintenance and operation, or which may <br />affect an improvement for which local government responsibility is <br />established. <br />PUBLIC RIGHT -OF -WAY. A strip of land accepted by the <br />City over which the public has the right to pass, and including the rights <br />to install and maintain a public street or other municipal improvements <br />such as water lines, sewer lines, and other similar facilities. The City <br />shall have the discretion to accept or reject the proposed dedication of <br />such rights -of -way, and may reject the dedication if encroachments, <br />encumbrances, or any other condition may limit the public's rights. <br />-6 <br />
