Stat. §462.355, subd. 4(c) authorizes the City
Council to extend an Interim Ordinance establishing a moratorium after a public hearing
is held and after written findings have been adopted by the Council.
In this regard, please find enclosed a proposed Ordinance extending the Interim
Ordinance established by ordinance No. 615, which will expire on September 26, 2007.
If the City Council intends to adopt the enclosed Ordinance, written findings should be
adopted prior to adoption of the enclosed Ordinance. Written findings similar to the
findings the Council adopted when Ordinance No. 615 was passed would suffice as
written findings required by the statute.
Would you please review the enclosed and contact me at your convenience to
discuss this matter.
Very truly yours,
SWEENEY, BORER & SWEENEY
"I'ho M n
TMS:jnm
Enclosure
cc: Kathy Glanzer, City Clerk
SFr to .1007
