MINUTES <br />CITY COUNCIL <br />NNE 27, 2007 <br />RESOLUTION NO. 2007 -6 -146 — AN ORDINANCE RESCINDING <br />ORDINANCE NO. 624 WHICH AMENDED SECTION 913.020 OF <br />THE ZONING ORDINANCE RELATING TO PERMITTED USES IN <br />THE `BW" BUSINESS-WAREHOUSING DISTRICT <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />CUP FOR Mayor Blesener opened the Public Hearing to consider a Conditional Use <br />GARAGE — Permit for a detached garage consisting of 1,500 square feet as requested <br />2988 by Roy French for property located at 2988 Edgerton Street. The Planning <br />EDGERTON Commission has recommended approval of the CUP as requested. <br />STREET — <br />ROY FRENCH <br />The City Planner reviewed his report dated June 21, 2007 relative to this <br />CUP request. The Planner noted that Mr. French plans to remodel his <br />existing attached garage into additional living space, and construct a 1,500 <br />square foot garage behind his home. The Planner reviewed Mr. French's <br />proposed driveway design, which involves retaining much of the driveway <br />that leads into the existing garage and adding additional driveway that <br />crosses the front yard and swings around the north side of the house and <br />over to the new garage location. The Planner pointed out that the Code <br />prohibits the parking of cars in front yards on other than driveways which <br />lead directly into a garage. <br />The Planner noted the recommendation in his June 7`h report that the <br />French driveway be relocated to the south side of the property. The <br />Planner indicated that Mr. French has reported that given the grade <br />changes on the south side of his home, a retaining wall would be necessary <br />in order to locate the driveway on the south side of the property. The <br />Planner reported that another option would be to move the driveway to the <br />north side of the property. The Planner indicated that while the Planning <br />Commission recommended approval of the CUP with the driveway <br />location as proposed by Mr. French, it is his that the driveway be moved to <br />the north side of the property. The Planner also recommended that the <br />CUP be subject to no business activity from the building, and no other <br />accessory storage buildings on the property. <br />Blesener asked the procedure for issuing a building permit for a 1,500 <br />square foot garage yet ensuring that the existing garage space is remodeled <br />into living space. The City Planner recommended that one building permit <br />be issued for the new garage and the remodel project. He indicated that a <br />Certificate of Occupancy would not be issued until both projects are <br />completed. If the existing garage is not remodeled as proposed, the City <br />7 <br />
