MINUTES <br />CITY COUNCIL <br />JUNE 27, 2007 <br />THE RENOVATION OF THE EXISTING GARAGE WITH NON <br />PERFORMANCE UNDER THAT AGREEMENT TO RESULT IN <br />LEGAL ACTION <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (2) Blesener, Allan. <br />Nays (2) Montour, McGraw. Resolution failed. <br />Mr. McGraw introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2007-6-149 — TABLING ACTION ON THE <br />REQUEST FOR CONDITIONAL USE PERMIT FOR 1,500 SQUARE <br />FOOT DETACHED GARAGE, 2988 EDGERTONSTREET, ROY <br />FRENCH PROPERTY, UNTIL THE JULY 11, 2007 REGULAR CITY <br />COUNCIL MEETING <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />McGraw asked how the City will ensure the redevelopment of the existing <br />attached garage into living space. The City Administrator explained that <br />this issue will be addressed in the Development Agreement. He also noted <br />that a Certificate of Occupancy for the new garage could be withheld <br />issued until the existing garage is renovated. A further safeguard would <br />be to require a letter of credit or cash escrow which the City would hold <br />until the renovation work is completed. <br />AMENDMENT Mayor Blesener opened the Public Hearing to consider an Amendment <br />TO THE to the zoning Code relative to the regulation of electronic and digital <br />ZONING sign technology. <br />CODE — <br />ELECTRONIC The City Planner reported that information was presented to the <br />AND Planning Commission on the in -depth study that the City of Minnetonka <br />DIGITAL did on this issue. The Planner reported that his office had just <br />SIGNAGE received this information and had not yet put together an ordinance <br />amendment proposal. Therefore, the Planning Commission tabled action <br />until their July meeting. <br />The Planner reported that the Minnetonka ordinance was put together as <br />part of a settlement agreement with Clear Channel. The City <br />Administrator reported that the League of Minnesota Cities Insurance <br />Trust participated in the Minnetonka study. He fell that this negotiated <br />15 <br />
