MINUTES <br />CITY COUNCIL <br />JUNE 27, 2007 <br />RECESS <br />CUP FOR <br />GARAGE — <br />ROY <br />FRENCH <br />A property owner asked if the City would be willing to purchase the <br />property for park land. Blesener noted that this property would not be <br />open to the general public; therefore, the City could not justify its <br />purchase as park land. The property owner noted that if the City <br />purchased the strip of land east of the street, it would be accessible to the <br />general public. Blesener suggested it could be possible that the property <br />came to the City as park land. <br />Blesener suggested that the next step was for the Hanson's to have their <br />property surveyed and meet with their Ontario neighbors to deteuuine if <br />they have interest in enlarging their back yards. <br />At this point in the meeting, 9:05 p.m., the Council took a short recess. <br />The meeting was reconvened at 9:17 p.m. <br />The City Attorney noted that the Council's motion on the Conditional <br />Use Permit for a garage relative to the Roy French property at 2988 <br />Edgerton Street failed. The Attorney described the options for the <br />Council which included making another motion or tabling action until its <br />next meeting at which the full Council will be present, and which will be <br />within the City's 60 -day review period. The Attorney also noted that State <br />Law requires the Council make findings as part of any action to deny. The <br />Attorney suggested that if the Council tables action to the July 11 `h <br />meeting, findings of denial will be prepared and present to the Council at <br />that meeting. <br />Blesener noted that one option would be to approve the CUP with the <br />condition that the driveway be moved to the north side of the property. <br />The Attorney agreed that that was an option the Council could consider. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2007 -6 -148 — APPROVING A CONDITIONAL <br />USE PERMIT FOR A DETACHED GARAGE CONSISTING OF 1,500 <br />SQUARE FEET, 2988 EDGERTONSTREET, ROY FRENCH <br />PROPERTY, SUBJECT TO THE DRIVEWAY BEING MOVED TO <br />THE NORTH SIDE OF THE PROPERTY AND THE EXISTING <br />DRIVEWAY BEING REMOVED, SUBJECT TO THE BUILDING <br />PERMIT TO INCLUDE THE RENOVATION OF THE EXISTING <br />GARAGE INTO LIVING SPACE, SUBJECT TO THERE BEING NO <br />BUSINESS USE OF THE PROPERTY AND NO OTHER <br />ACCESSORY STORAGE BUILDINGS BEING ALLOWED, AND <br />SUBJECT TO THE PROPERTY OWNER ENTERING INTO A <br />DEVELOPMENT AGREEMENT WITH THE CITY RELATIVE TO <br />14 <br />
