the public right -of -way and permission must be obtained from the property owner where said <br />sign will be located. Any sign not complying with these provisions may be removed without <br />notice. <br />2. Prohibited Signs. The following signs are specifically prohibited by this <br />Ordinance. <br />a. Any sign which obstructs the vision of drivers or pedestrians, or detracts <br />from the visibility of any official control device. <br />b. Any sign which contains or initiates an official traffic sign or signal, <br />except for private, on- premise directional signs. <br />c. Any sign which moves or rotates. Exempted are time and temperature <br />information and barber poles. <br />d. Except for holiday signs and exceptions provided in provision C, 4. <br />below, any sign which contains or consists of banners, pennants, ribbons, streamers, strings of <br />light bulbs, spinners, or similar devices. <br />e. Portable signs (except in case of paragraph C, 4.). f. Signs which are <br />attached in any manner to trees, fences, utility poles, or other such permanent supports, except <br />for those signs found on fences (inside) of baseball parks. <br />g. No sign shall display any moving parts, nor shall it be illuminated with <br />any flashing or intermittent lights, nor shall it be animated. Exempted are time and temperature <br />information and barber poles. All displays shall be shielded to prevent any light to be directed at <br />oncoming traffic in such brilliance as to impair the vision of any driver. No device shall be <br />illuminated in such a manner as to interfere with or obscure an official traffic sign or signal. <br />h. Roof signs erected after the effective date of this Ordinance. <br />i. Any temporary off - premise sign, except as expressly allowed by this <br />Ordinance. <br />C. General Provisions. <br />1. All signs shall comply with maintenance sections of the Minnesota State <br />Building Code as may be amended. <br />2. When electrical signs are installed, the installation shall be subject to the State <br />Building Code as may be amended. <br />a. Regulations for Dynamic Signs. Based on studies related to the use of <br />dynamic sign displays and driver distraction, the City finds that dynamic signs, as defined by the <br />zoning ordinance, have a unique ability to create driver distraction, a major cause of traffic <br />crashes. As a result, the City has adopted special regulations that relate to such signs. These <br />regulations shall apply to all proposed dynamic signage in the City, whether new or existing, <br />conforming or non - conforming at the time of adoption of this ordinance. <br />i. No dynamic sign shall have lettering smaller than 10 inches <br />in height. <br />ii. Dynamic signs shall have messages that change <br />instantaneously, and do not fade, dissolve, blink, or appear <br />to simulate motion in any way. Such signs may change by <br />turning off for a period of at least 10 minutes between <br />displays. <br />iii. Dynamic signs shall not be permitted in any Residential <br />zoning district. <br />
