prohibited mailing. <br />k. The City shall impose a $2,500 charge per billing cycle should the <br />Contractor fail to notify the City, within 30 days of a reduction in <br />tipping fees as required by this agreement. In addition to this charge, <br />the Contractor shall also make a refund to the City in the next billing <br />cycle of any amount overcharged. <br />4. Legal Compliance. <br />a. This Contract is governed in all respects by the laws of the State of <br />Minnesota, and all obligations are enforceable in accordance <br />therewith; and the Contractor, where required, must obtain all licenses <br />or permits to transact a refuse collection business in the City of Little <br />Canada, Ramsey County, and the State of Minnesota. <br />b. The Contractor will acquaint itself with all pertinent City Ordinances <br />and shall comply with all health rules, regulations, and Ordinances of <br />the City of Little Canada, Ramsey County, and the State of Minnesota <br />in effect at this time of this contract or hereafter adopted. In the <br />event, there is a conflict between the provisions of this contract and <br />the pertinent ordinances, regulations, and statutes the more stringent <br />requirements shall apply. <br />c. The Contractor shall report all violations of ordinances pertaining to <br />garbage and refuse collection and disposal for enforcement purposes <br />including all unsanitary or filthy conditions to the City. <br />5. Safety. <br />The Contractor shall provide and maintain all sanitary and safety accommodations <br />for the use and protection of its employees as may be necessary to provide for their <br />health and welfare and comply with federal, state, and local codes and regulations, as <br />well as those of other bodies and tribunals having jurisdiction. Employee safety and <br />sanitation facility regulations are set forth in Minnesota Statutes 182 and in the <br />Department of Labor and Industry's Labor Safety Code (LISC 73 -75). <br />D. Compensation. <br />1. Base Compensation. City and Contractor shall on a monthly basis, verify <br />the number of households at each level of collection service and the <br />additional billable serviced provided during the month. The verification <br />procedure will use the prior month's ending service counts adjusted by the <br />weekly change reports submitted by the City plus the current month's <br />cumulative additional services requested through the weekly change reports, <br />-16- <br />
