Manson <br />TO: Mayor 13lesener & Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: December 16, 2011 <br />RE: Stipulation & Discontinuance of Nonconforming Use Agreement — 2572 Edgerton <br />In the early 1980, the owner of the property at 2572 Edgerton was allowed to construct a new house <br />while allowing occupancy of the existing cabin /house. When the home was vacated, it was converted to <br />a "boathouse" and allowed to remain on the property (see 1981 agreement attached). That conversion <br />did occur. <br />Recently, the property owner located immediately to the north purchased 2572 Edgerton. He wanted to <br />obtain a building permit for remodeling of the structure to make it a more active use given its proximity <br />to the water. With new statutory requirements governing non - conforming uses, the permit application <br />was allowable as long as the structure did not become a housing unit. (See memo from Steve Grittman <br />dated 10/24/11 attached). <br />To ensure that residential occupancy of the "boathouse" is not reestablished, the City Attorney prepared <br />the attached Stipulation & Discontinuance of a Nonconforming Use Agreement based on the outline <br />provided by the City Planner. This agreement documents that a residential use cannot be reestablished <br />within this structure and provides for how that situation will be governed. <br />Staff recommends approval as presented. <br />cc: Jason Reissner <br />1 <br />
