A <br />Agreement, dated this 18th day of December, 1901, by and between THE CITY <br />OP LITTLE CANADA, a liuni cipal Corpora1:i.on, hereinafter called City, and ANDREW <br />KEI. @l:, hereinafter called Owner. <br />WIlNESSETI : <br />WHEREAS, Owner i.a constructing a single family dwelling on his property, <br />hereinafter described, in the City of Li.11le Canada, and <br />WHEREAS, said property is a single lot measuring approximately one acre in <br />size and aa.ready has standing upon it a summer cottage which constitutes a <br />non - conforming use under the present Little Canada Zoning Ordinance, and <br />WHEREAS, Owner applied to the City and was issued a building permit for <br />said new home hut said permit was issued in error, and <br />WHEREAS, City and Owner desire to bring the subject property into <br />conformity with the local. Ordinances without creating undue hardship for Owner, <br />and <br />WHEREAS, Owner has a restriction on his title which provides that the <br />grantor, his aunt, Harriet Kelbe, age Oh, shall. have a life estate interest i.n the <br />said property and use of said cottage. <br />NOW, THEREFORE, in consideration of the nmtual covenants and agreement <br />herein contained, the parties hereto agree as follows: <br />1. Owner agrees that he will relocate, convert: into a boat house, or <br />altogether remove said cottage so as to bring the said property into conformity <br />with the City Zoning and Building Codes within six months following the occurrence <br />of any of the following events: <br />(a) Death of his aunt, Harriet Kelbe; <br />(b) Permanent residency of Harriet Kelbe in a nursing home or <br />other facility tor the aged; <br />(c) Cessation of residency of Harriet Kelbe within Little <br />Canada. <br />In the event Owner elects to relocate said cottage on the same property, <br />he agrees to subdivide the property into at ].east two lots in a way which shall . <br />result: i.n terminati.on of any non - conforming use <br />
