NORTHWEST ASSOCIATED CONSULTANTS, INC. <br />4300 Olson Memorial Highway, Suite 202, Golden Valley, MN 55422 <br />Telephone: 763.231 .2555 Facsimile: 763. 231 .2561 planners(dinacplanning.com <br />MEMORANDUM <br />TO: Joel Hanson <br />Steve Westerhaus <br />FROM: Stephen Grittman <br />DATE: October 24, 2011 <br />RE: Little Canada — 2572 Edgerton "Boathouse" <br />NAC FILE: 758.10 general <br />Following is the summary of discussions re: 2572 Edgerton, and the remodeling of the <br />"boathouse ". <br />® The structure is a legal, non - conforming structure and can continue in its current <br />size and location. <br />® The statutory requirements for such structures permit remodeling, maintenance, <br />and even complete replacement. <br />® If the structure were removed, damaged or lost, the property owner can entirely <br />replace it if a building permit is requested within 6 months, and the work is <br />completed within 12 months. <br />® Thus, the siding, roofing, windows are all eligible maintenance activities. <br />There is one particular restriction on remodeling, and that would relate to the use of the <br />structure. Previous permits were granted, essentially allowing construction of another <br />home on the property in the early 1980s, to accommodate the temporary continuation of <br />a living unit in the "boathouse" building, along with the construction of a new home. <br />The use of the "boathouse" structure as a living unit was to terminate upon the death or <br />departure of the occupant, which has since occurred. <br />As such, permits to remodel the boathouse structure need to be considered in the <br />context of its use as an accessory structure, but in a way that does not constitute a <br />dwelling unit.
