STIPULATION OF NOTICE AND DECLARATION <br />01? DISCONTINUANCE OF NONCONFORMING USE <br />THIS NOTICE AND DECLARATION is made this day of , 20 , <br />by JASON J REISSNER. <br />WHEREAS, Jason J. Reissner ( "Reissner ") is the owner of certain real property located at <br />2572 Edgerton Street in the City of Little Canada, County of Ramsey, State of Minnesota ( "City "), <br />legally described on the attached Exhibit A (the "Property "); and <br />WHEREAS, the Property is located within an residential zoning district established under <br />the City's Zoning Ordinance which limits residential dwellings to one dwelling per property; and <br />WHEREAS, the Property contains a principal residential dwelling, and a second structure, a <br />"boathouse." Approximately 30 years prior to this Declaration, the City gave temporary permission <br />to use the boathouse as a residence during construction of a new home on the Property. The use of' <br />the boathouse as a residence was to terminate upon the death or departure of that occupant, which <br />has since occurred; and <br />WHEREAS, Reissner acquired the Property in 2011, and submitted applications for permits <br />to remodel the boathouse; and <br />WHEREAS, the City Building Official indentified the boathouse as a legally <br />nonconforming structure, which can be maintained through re- siding, re- roofing, and replacing <br />windows; and <br />WHEREAS, use of the boathouse as a residential dwelling is not a legal nonconformity, and <br />thus potential for use of the boathouse building as a dwelling stands in violation of the City's zoning <br />ordinance; and <br />WHEREAS, Reissner and the City have agreed to this Notice and Declaration, which shall <br />1 <br />8 <br />
