That garage has been constructed, and the owners of the structure are <br />seeking to subdivide the garage in order to have individual ownership of each stall. This <br />was their intention from the beginning of this process, and the City Planner had indicated <br />that the situation is allowed by condo law. The Planner's recommendation was a PUD <br />Agreement in place to ensure that the sale or use of the individual garage stalls occur only <br />in association with the use, ownership, and occupancy of the office building portion of <br />the PUD (See Planner's October 5, 2010 report attached). <br />The City Attorney is in the process of preparing the PUD Agreement to address this <br />situation.
