The intent of the approval of the storage building would be to provide accessory storage <br />exclusively for the occupants of the office development. An amendment to the PUD <br />agreement should be included that specifies that the sale or use of the storage building <br />units may only occur in association with the use, ownership, and occupancy of the office <br />building portion of the PUD. The PUD amendment is expressly not intended to allow <br />storage to be made an independent use of the project. <br />PUD Agreement. As a condition of PUD amendment approval, the applicant should <br />enter into a PUD Amendment agreement with the City. This issue should be subject to <br />further comment by the City Attorney. <br />Recommendation <br />Based on the preceding review, Planning Staff recommends approval of the PUD <br />amendment subject to the following conditions: <br />1. Updated (current) documentation be provided from Xcel Energy which would <br />make an allowance for the proposed accessory building encroachment. <br />Such documentation shall be subject to review by the City Attorney. <br />2. The accessory building be subject to any additional height andtor material <br />requirements imposed by Xcel Energy. <br />3. The accessory building match the existing office buildings in color. <br />4. For trash equipment containment, a "wing wall" be extended along the south <br />and east sides of the trash handling area. Such wall should be an extension <br />of the accessory storage building and utilize similar finish materials. <br />5. Not less than 117 off- street parking stalls be provided upon the subject site. <br />6. The storage building shall be utilized solely as an accessory to the office park <br />use, and no separate sale or occupancy would be permitted. <br />7. The applicant enter into a PUD Amendment agreement with the City.
