Development Contract <br />the City shall provide Developer with written notice of the violation. Developer shall be allowed <br />thirty (30) days to correct said violation to the City's satisfaction or the City, in its sole <br />discretion, may require Developer to forfeit the financial guarantee , and the City shall retain the <br />entire amount of such financial guarantee or at its option use the financial guarantee to complete <br />part or all of the Improvements. The City shall not be required to provide any notice or <br />procedures other than those contained within the financial guarantee document filed with the <br />City. The City shall have the right to enter upon the property to inspect work or complete all or a <br />portion of the Improvements as necessary. In the event the City does any such work, the City <br />may, in addition to its other remedies, assess against the Property any costs that the City incurs <br />which exceed the amount of the financial guarantee. <br />11. Developer shall be responsible for any Water Availability Charges and /or Sewer <br />Availability Charges associated with any improvements made to the building that trigger their <br />application, including any charges imposed by Metropolitan Council Environmental Services <br />that may become due with any building permits required by improvements to The Property. <br />12. No park dedication fees shall be payable for The Property. <br />The Improvements <br />13. Due to the lack of general maintenance and repair that to the existing structure on <br />The Property, Developer agrees to complete the following work by no later than July 1, 2008: <br />• Removal of all rank growth of trees and weeds around perimeter of building and in <br />the fenced area along the west side of the property. <br />• Paint portion of east wall to closely match color of the majority of the adjoining <br />surface. Said area to be painted is roughly 10 feet by 16 feet in size. <br />• Maintain all landscaped /grass area in a manner consistent with Little Canada <br />nuisance codes to ensure that rank growths of weeds are prevented and that grass <br />is mowed to reasonable standards. <br />
