Development Contract <br />forfeit and retain the entire amount of such financial guarantee or at its option use the financial <br />guarantee to complete part or all of the Improvements. The City shall not be required to provide <br />any notice or procedures other than those contained within the financial guarantee document <br />filed with the City. The City shall have the right to enter upon the property to inspect work or <br />complete all or a portion of the Improvements as necessary. In the event the City does any such <br />work, the City may, in addition to its other remedies, assess against the Property any costs that <br />the City incurs which exceed the amount of the financial guarantee. <br />11. Developer shall be responsible for any Water Availability Charges and /or Sewer <br />Availability Charges associated with any improvements made to the building that trigger their <br />application, including any charges imposed by Metropolitan Council Environmental Services <br />that may become due with any building permits required by improvements to The Property. <br />12. No park dedication fees shall be payable for The Property. <br />The Improvements <br />13. Due to the lack of general maintenance and repair that to the existing structure on <br />The Property, Developer agrees to complete the following work by no later than July 1, 2008: <br />• Staining of the entire area of existing wood treatment where the Knox sign was <br />located to ensure that "Knox" can no longer be seen on the wood. Said staining <br />shall be done in a manner to ensure that the stained area and any unstained areas <br />are visually indistinguishable. <br />• Removal of all rank growth of trees and weeds around perimeter of building and in <br />the fenced area along the west side of the property. <br />• Repair of the main entry door area on the north east corner of the building to <br />present a reasonable appearance. <br />• Paint portion of east wall to closely match color of the majority of the adjoining <br />surface. Said area to be painted is roughly 10 feet by 16 feet in size. <br />5 <br />
