MINUTES <br />CITY COUNCIL <br />DECEMBER 20, 2006 <br />people do not just stay on the trail itself, but wonder off and end up <br />trespassing on private property. Miranda indicated that this is occurring <br />now and he occasionally has people walking through his back yard. <br />Miranda stated that he is about 75 feet from the existing trail in this area. <br />The City Administrator suggested that before Canadian Woods moves to <br />Final Plat that there be additional review and consideration by the Parks <br />Commission, and that there be discussions with Pat Johnson and the <br />Maplewood property owners. The Administrator suggested that it may be <br />possible to accomplish everyone's objectives. Blesener agreed. <br />Himelbach suggested that the impacted property owners should have final <br />say relative to privacy issues. The City Administrator noted that the City <br />does give consideration to the screening of trail improvements from <br />private properties. <br />Johnson noted that the City's ordinance allows for up to 10% of land area <br />as a park charge, and pointed out that the Park Commission is talking <br />about the full easterly portion of his land abutting Maplewood. <br />Blesener suggested that the Council could table action on the Preliminary <br />Plat or act to approve it subject to compliance with the Parks <br />Commission's recommendation and the specific and details being worked <br />out. Johnson stated that he was agreeable to meeting with the City to <br />work out the park charge /trail details. Blesener suggested that <br />consideration would be given to how much land is needed as well as <br />whether or not it is feasible to put a trail through this area. <br />Johnson expressed frustration over the park charge /outlot issue indicating <br />that for the past five months he has been trying to fmd out issues related to <br />this portion of the property. The City Administrator pointed out that there <br />has been discussion about the various issues should the outlot be sold to <br />the Maplewood property owners. These issues include access, <br />governance, usage, etc. The Administrator pointed out that it is a <br />complicated issue. The Administrator also pointed out that Johnson's <br />position had changed from the property being platted as an outlot, to the <br />property being combined with Lot 7, and back to the property being <br />platted as an outlot. The Administrator indicated that the City has tried to <br />work with Johnson on resolving the park charge /outlot issue. <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />Upon motion by Blesener, seconded by Montour, the public hearing was <br />closed. <br />0 <br />-8 <br />
