As you will notice, the enclosed Interim Ordinance does not specify an
expiration date in Paragraph (C).
Minn. Stat. §462.355, subd. 4, provides that an Interim Ordinance may be enacted for a
period not to exceed one year. Therefore, the Council has the authority to establish a
moratorium for twelve months, or for a shorter period, by specifying the expiration date in the
enclosed Ordinance.
Would you please review the enclosed to determine if any additions or deletions will be
beneficial. Also, would you please verify that the City is concerned about plats of four or more
lots as opposed to three or more lots. Assuming the enclosed is acceptable, would you please
submit the same to the Council for their consideration and review.
If anyone has any questions relative to this matter, please contact me.
Very truly yours,
SWEENEY, BORER & SWEENEY
Thomas M.
