• Licenses may be denied or rescinded if the premises of the establishments do not <br />meet the requirements of the City Council, and of the building, safety and <br />sanitation regulations of the City of Little Canada, and State of Minnesota. <br />• Licenses may be denied or rescinded if there is any fraud or deception involved <br />in the license application. <br />• Licenses may be denied or rescinded if the applicant, licensee or employee of the <br />same fail to comply with, or have a history of violations of the laws or ordinances <br />which apply to health, safety, or moral turpitude. <br />• The City Council may attach such reasonable conditions to the license as it, in its <br />sole discretion, deems to be appropriate. <br />• The City may run criminal history checks on any applicant for a license pursuant <br />to this chapter. <br />• A license for massage therapy shall be reviewed annually. No license approved by <br />the City grants the licensee a property right or entitlement to a license. The City <br />Council may refuse to issue, refuse to renew, or may suspend or revoke a license <br />for any reason, and the City will not incur liability for any damages including, but <br />not limited to, direct, consequential, or incidental damages, deprivation of property, <br />loss of income, loss of profits, or loss of livelihood. <br />Parking. The facility would be part of an existing retail strip center which has adequate <br />parking for retail uses, according to ordinance requirements. No issues are expected <br />with this new use. <br />Alternative Actions <br />Regarding the application for a Conditional Use Permit for massage therapy in the PUD <br />District, the City has the following options: <br />1. Motion to approve the Conditional Use Permit, based on a finding that the <br />proposed use meets the conditions of approval and may be adequately served <br />by the proposed location. <br />2. Motion to deny the Conditional Use Permit, based on a finding that the conditions <br />for approval and /or licensing requirements have not been met. <br />Summary and Recommendation <br />The Zoning Ordinance contains provisions for allowing the proposed use in the B -3 <br />District and the use appears to meet the conditions of approval. The available parking <br />appears to be adequate, and no other issues with the business are apparent. All <br />3 <br />
