Findings of Fact for Approval <br />Cul -de -Sac Length Variance <br />Richie Place <br />Little Canada, Minnesota <br />1. Richie Place is a proposed plat of single family lots, all of which meet the zoning <br />ordinance regulations for area, width, and other applicable zoning standards. <br />2. The proposed platted area is guided by the Comprehensive Plan for low density <br />residential uses. <br />3. The proposed Richie Place plat is consistent with the land use plan. <br />4. Each of the proposed lots exhibits a buildable area consistent with the zoning <br />requirements for single family homes. <br />5. The proposed plat complies with all requirements of the City's ordinances, and <br />was recommended for approval by the Planning Commission, with the conditions <br />as follows: <br />a. Consistent with Planning Commission recommendation, the applicant <br />provides a landscaping plan for ponding area acceptable to the City. <br />b. Consistent with Planning Commission recommendation, the applicant <br />provides a tree preservation and replacement plan acceptable to the City. <br />c. Consistent with Planning Commission recommendation, the applicant <br />complies with all final recommendations of the City Engineer. <br />d. Consistent with Planning Commission recommendation, a final resolution <br />for joint utility services for the area is reached with the City of Maplewood. <br />6. The plat's proposed street, at a length of approximately 1,050 feet, is eligible for <br />a variance to the Subdivision Ordinance maximum of 500 feet, based on findings <br />as follows: <br />a. The Subdivision Ordinance requires that subdividers extend streets within <br />a proposed plat to neighboring property to provide opportunity for future <br />development, per Subdivision Ordinance Section 1006.030 (a). This <br />results in an undue hardship pursuant to Subdivision Ordinance Section <br />1010.010 (a). <br />b. There are no other options for access to this property that would provide <br />the opportunity for full development of the subject property, nor to <br />adjoining property that would be consistent with the Subdivision Ordinance <br />as required by Subdivision Ordinance Section 1006.030 (a). This results <br />in an undue hardship pursuant to Subdivision Ordinance Section 1010.010 <br />(a). <br />3 <br />
