c. Undue hardship is present in putting the property to a reasonable use if <br />strict compliance with the 500 foot cul -de -sac regulation is required, per <br />Subdivision Ordinance Section 1010.010 (c). <br />d. Without the variance, the applicant will not be able to put his property to <br />reasonable use since much of the area will be inaccessible, per Section <br />1060.030 (c). This results in an undue hardship pursuant to Subdivision <br />Ordinance Sections 1010.010 (a) and (c). <br />e. The proposed cul -de -sac is temporary in nature, with the possibility that <br />the street would be extended into adjoining property in the future, per <br />Subdivision Ordinance Section 1060.030 (b) and (d). This finding is <br />consistent with Subdivision Ordinance Section 1010.010 (b). <br />f. When the stub - street is extended to Beam Avenue to the east, the cul -de- <br />sac will no longer exceed the 500 foot regulation in accordance with <br />Subdivision Ordinance Section 1006.030 (b). This finding is consistent <br />with Subdivision Ordinance Section 1010.010 (b). <br />7. The development of the proposed plat will provide an opportunity to extend both <br />public sanitary sewer and water systems to other properties in the area which do <br />not have access to full services, consistent with City policy, and Subdivision <br />Ordinance Section 1008. This finding is consistent with Subdivision Ordinance <br />Section 1010.010 (b). <br />8. Per City Comprehensive Plan policy, the lack of current public sanitary sewer <br />and water in the area constitutes a hazard to environmental conditions and public <br />safety. This finding is consistent with Subdivision Ordinance Section 1010.010 <br />(b). <br />9. The plat provides future access to other portions of the neighboring properties <br />which would otherwise be landlocked and unusable as required by Subdivision <br />Ordinance Section 1006.030 (a). This finding is consistent with Subdivision <br />Ordinance Section Sections 1010.010 (a) and (c). <br />10. The proposed plat improves stormwater runoff, water quality, and flooding <br />conditions in the area through the use of detention and infiltration ponding to <br />divert and control stormwater which is currently a threat to adjoining property, <br />consistent with Subdivision Ordinance Section 1006.050. This finding is <br />consistent with Subdivision Ordinance Section Sections 1010.010 (b). <br />11.The conditions cited herein constitute special and unique circumstances with <br />would deprive the applicant of the reasonable use of his land, consistent with the <br />requirements of Subdivision Ordinance Section 1010.010 (a). <br />12. The granting of the variance will not only not be detrimental to public health, <br />welfare, and nearby properties, but will improve conditions of stormwater, <br />4 <br />
